The Casual Workers Advice Office (CWAO) was founded in 2011 as a non-profit, independent organisation. It provides advice and support to workers, privileging casual, contract, labour broker and other precarious workers.

CWAO seeks to appoint a Strategic Litigation Attorney to be based in Germiston, Johannesburg.

Salary commensurate with experience and the Centre’s remuneration framework.

Applicants must share with the CWAO a commitment to protecting workers’ rights and to using law as an instrument of justice.

This position provides a unique opportunity to work for social justice in a dynamic and rapidly evolving area of law.

Responsibilities:

  • Strategic litigation
  • Regular appearances at CCMA/Bargaining Councils
  • Labour Court appearances in interdicts, trials and review applications
  • Act as instructing attorney to counsel for Labour Appeal Court and Constitutional Court litigation
  • Legal drafting
  • Supervising and training of candidate attorneys and paralegals
  • Establishing systems for recording, tracking, follow-up and reporting on cases
  • Reporting and compliance

Requirements:

  • Up-to-date knowledge of labour legislation in substance;
  • Up-to-date knowledge of practice and procedure in the CCMA/Bargaining Councils and Labour Courts;
  • Legal writing skills
  • Legal research skills;
  • Computer literate (typing, word, excel, internet., email);
  • Ability to take direction in a collective, democratic worker-led environment;
  • Strong commitment to high-quality client service.

Preferred qualifications and experience:

  • Admission as a practising attorney for at least three years
  • Experience in labour and human rights litigation preferably including CCMA and Labour Court experience
  • Demonstrated background in worker and human rights
  • Fluent in English and at least one other official South African language
  • Valid Driver’s licence
  • Applicants must be available to work on Saturdays

The organisation was formed out of the recognition that the traditional labour movement appears incapable or unwilling to organize the new kinds of workers created by neo-liberalism. This recognition also informs the emphasis the CWAO places on precarious workers beginning to organize themselves. The old industrial model of organizing seems unsuitable for precarious workers. Indeed, it seems no longer suitable for traditional industrial workers themselves. The new organizational forms that will take its place will be determined by workers through struggle. It is through organisation that precarious workers will best defend their rights, improve upon those rights, and connect with broader struggles for social justice and an egalitarian society
