TERMS OF REFERENCE

BACKGROUND AND SCOPE OF WORK

Since the conflict began in South Sudan, more than 2 million South Sudanese have been internally displaced and another 2.4 million have fled to neighboring countries. Land use and ownership is at the heart of the ongoing conflict. Given the nation’s insufficient legal frameworks and land governance institutions, the likelihood for land-related conflicts (particularly given increased returns) is high. As more than 90% of all land in the country is held without formal title, and as frequently discriminatory customary arbitration is the primary means of settling land-related disputes, the introduction of HLP rights-based education and resources are crucially needed. With the potential for large-scale returns on the horizon, coupled with potential secondary occupation, the destruction of existing housing and property, disputes over land ownership and use, and a loss of records, the potential for exacerbation of underlying conflicts is very high. HLP guidance must be mainstreamed into humanitarian programming, and awareness-raising campaigns on HLP rights, roles and responsibilities are crucially important for beneficiaries and land authorities. By paying heed to the nuanced and contentious issues of land and property, we may potentially mitigate potential conflicts surrounding these issues.

In 2015, IOM developed a fundamental guidance document for all shelter actors, known as the HLP Due Diligence Guidelines. This crucially important publication serves to guide the ethical, sustainable and secure provision of SNFI and HLP services by humanitarian and civil society practitioners. This document guides practitioners in providing services without exacerbating or reigniting existing conflicts, while ensuring action is truly necessary and appropriate, based on intensive information-gathering from initial to final assessments. IOM seeks to expand its work on durable and sustainable HLP interventions by developing a comprehensive toolkit that will be used to train community leaders and focal points on HLP rights so they are able to effectively share this information with their community, thereby building grassroots understanding of the HLP rights guaranteed to all citizens via national legislation and policy.

SCOPE AND DELIVERABLES

IOM is seeking an expert to develop a comprehensive toolkit to be used for the education of community HLP Focal Points. The consultant will incorporate education regarding fundamental HLP legislation; Collaborative/ Alternative Dispute Resolution services, and guidance on training others, so selected focal points may widely share their knowledge on HLP in their communities.

DELIVERABLES

1. Deliver a detailed and comprehensive toolkit inclusive of a training manual that can be applied in the community, including modules on selection of HLP focal points, HLP due diligence for different actors, community engagement on HLP rights, women’s rights, international frameworks, and relevant components of the forthcoming national land policy;
2. Deliver a resource pack on how to train on the aforementioned manual for field staff
3. Conduct an initial training for IOM staff, partners and field teams on the utilization of this training manual, including the production of a training report on the same
4. Field test the training manual with the first cohort of the selected HLP Community Focal Points, HLP focal points, current chiefs/ community arbitrators, and/or respected community decision makers.

CONSULTANCY DETAILS

The individual/consultancy firm is to carry out the required tasks with a mix of home-based and South Sudan-based work. The Consultant will jointly report to IOM’s Protection Project Manager and the HLP Officer, who will provide guidance; review; and endorsement of the deliverables, as per the schedule below.

PAYMENT SCHEDULES

a) Upon negotiation and signing of the contract – 10%

b) Submission of the draft manual – 30%

c) Submission of the draft resource pack for use by staff on application of the manual -20%

d) Upon submission of the final manual and resource pack – 40%

CONSULTANT’S SPECIFICATIONS

The nature of this topic and scope of work requires a highly specialized individual with extensive relevant experience, and the highest level of expertise in land rights, administration, and governance in South Sudan and/or other conflict-affected contexts.

· Masters or equivalent in conflict resolution, gender, law, political science, international human rights or similar;

· A minimum of 7 years’ experience working with communities on dispute resolution especially on gender, research on human rights, administration, and governance;

· A minimum of 4 years’ experience working on land rights, administration, and governance issues in South Sudan and knowledge of the existing legal and policy frameworks;

· Experience advising on dispute resolution methodologies, gender, human rights, and governance in conflict-affected environments other than South Sudan (within international organizations, governments, or donor agencies); and

· In depth knowledge of the political, economic, humanitarian, and development landscape in South Sudan, including knowledge of relevant actors on the ground; and

· Fluent written and oral English, excellent drafting and report writing skills, and highly proficient computer skills
