1. Introduction

Terre des Hommes Netherlands (TdH-NL) is a child rights organisation committed to stopping child exploitation. TdH-NL works towards a world where all children have a decent life and can grow up to be independent adults; a world in which children are no longer exploited. TdH-NL embraces the principles and commitments enshrined in the UN Convention on the Rights of the Child and the International Labor Organization Conventions 138 and 139 relating to the protection of children from exploitative and abusive child labour. TdN-NL has published research on the Global Mica Supply Chain in India and Madagascar specifically. As a founding member of the Responsible Mica Initiative, TdH-NL works together with stakeholders across industries and sectors to eradicate child labour in the mica industry.

2. Background:

TdH-NL conducted three studies in the context of child labour in the mica industry. The first research ‘Beauty and a Beast” conducted in 2016 revealed that over 20,000 children are involved in the Indian mica industry in Jharkhand and Bihar. The second research ‘Global Mica Mining’ conducted in 2018 shows that, the risks of child labour and children’s right violations are also existing in other mica sourcing countries, such as Madagascar, Brazil, China, Sri Lanka and Pakistan. This study showed that further research is needed to better understand the child labour; risks and root causes in these countries. UNICEF responded to this call by initiating conversations to conduct research on Mica mining and children’s rights violations in Madagascar. Consequently, UNICEF and TdH-NL conducted a research study on child labour and mica mining in Madagascar, published by Terre des Hommes Netherlands in 2019. This study revealed that an estimated 10,800 children are working in mica mining in southern Madagascar.

3. General objective:

In view of the research outcomes of the Child Labour in Mica Mining in Madagascar report, TdH-NL intends to establish a country presence in Madagascar, including formal / legal registration with the government of Madagascar, and map and work in partnership with local organisations with the objective of ending child labour in the mica mining communities in Madagascar.

4. Specific objectives and main tasks:

Under the direct supervision of TdH-NL Programme Development Manager in the East Africa (EA) regional office and in cooperation with the TdH-NL Mica Programme Coordinator in the Head Office in the Netherlands, the consultant is expected to undertake the following tasks;

  1. Register TdH-NL as an INGO in Madagascar with the relevant authorities.
  2. Support the identification and partner selection process of strategic, suitable local NGOs in Madagascar to partner with TdH-NL in the implementation of the project interventions.
  3. Support recruitment of key staff and setting up of a project office.

The main tasks for the assignment are the following:

  • Guide and support the TdH-NL registration process with the Government
  • Identify a suitable local partner and undertake initial organisational capacity assessment
  • Guide and support office set up in Madagascar (national and field level in the South)
  • Support local staff recruitment and onboarding as guided by TdH-NL

5. Expected outcomes and deliverables:

i) The final registration certificate shared or evidence (documents) of the complete registration process, pending issuance of a certificate.

ii) A suitable partner selected to host the initial TdH-NL office in Madagascar and the establishment of an MOU with them supported.

iii) A local implementing partner for the MICA pilot project identified.

iv) Relevant TdH NL Madagascar staff recruited and on-boarded.

v) A final report (including validation feedback) on the entire consultancy assignment covering the main tasks, submitted to TdH-NL and verified by the EA regional office in Kenya.

The processes will be done in consultation with TdH-NL and using tools and documents approved by TdH-NL.

6. Process:

The consultant will provide updates on a weekly basis to TdH-NL on the ongoing registration process via skype/zoom/google hangout. He/She will also share scanned copies of the registration process documentation with TdH-NL and the EA Regional Office in Kenya as evidence of the on-going process on a weekly basis.

7. Duration:

The duration for this assignment shall be 60 days, to be completed within one year of contract signing. The terms and conditions of the assignment will be detailed in an individual consultancy contract between TdH-NL and the consultant.

8. Remuneration- Lump Sum Amount

This contract is based on lump sum remuneration and shall be processed subject to deliverables as per the schedule listed below;

i) 30% upon signing of the contract

ii) 40% upon delivery of registration certificate, staff recruitment and identification and assessment of a local partner

iii) 30% upon successful completion of all tasks and deliverables as per sections 4 and 5 above

9. Required Qualifications, Skills and Experience:

Education:

Minimum of a Master’s Degree in Law, Social Sciences, or other relevant fields is required.

Experience:

  • At least 8 years of demonstrated work experience in NGO management, designing and delivering programmes in child protection is required.
  • Excellent knowledge of up-to-date specifics and trends of the NGO sector in Madagascar is required.
  • Great understanding of NGO legislative environment and requirements in Madagascar is a must.
  • Proven experience and knowledge of child protection programmes and interventions especially in relation to labour, mining laws and gender is highly regarded.
  • Experience in negotiating, establishing and fostering lasting partnerships with Government and other key stakeholders.
  • Good experience in socio-cultural, geopolitical and economic country context is a strong asset.

Language requirements:

  • Fluency in spoken and written English and French is required. Malagasy is desirable.

Competencies:

  • Committed to professionalism, impartiality, accountability and integrity.
  • Displays cultural, gender, religion, race, nationality, ethnicity, and age sensitivity and adaptability.
  • Excellent communication skills, both orally and in writing.
  • Ability to establish effective working relations in a multicultural team environment, including with government institutions.

10. Child Safeguarding Measurers:

In line with the UNCRC, TdH-NL strives to keep children safe in all its undertakings. A screening and reference check of the successful candidate will be conducted during the selection process. The successful applicant will be required to read, understand, and commit (through signing) to abide by TdH-NL’s Child Safeguarding Policies and Guidelines.
