Project Summary:
The USAID Legal Professional Development and Anti-Corruption Program (LPAC) is five-year project implemented by Checchi and Company Consulting and consists of two components. The first component directs capacity building to the four key Liberian justice sector institutions that educate, regulate and inform legal professionals. The second component, under a sub-contract with MSI, supports the Liberian Anti-Corruption Commission (LACC) and associated Government of Liberia entities in their efforts to investigate and prosecute corruption cases, supports enhancing organizational structures and systems of the LACC, promoting education, outreach and prevention activities, and assists the LACC in its anti-corruption leadership and coordination roles.
Position Summary:
MSI is seeking an international consultant with experience in drafting and implementing whistleblower legislation. The whistleblower law was drafted several years ago and was extensively discussed among stakeholders. While the draft was filed with the National Assembly, it is still at committee stage. At the same time, the Presidential Order requires governmental agencies establish policies and procedures for receiving and processing whistleblower disclosures and protecting whistleblowers.
The consultant will review the current draft law and other relevant legislation, review relevant institutional framework and court cases, consult with stakeholders, and provide technical advice on developing or improving legislation in Liberia taking into account country context. The consultant will also conduct training for representatives of the law enforcement and regulatory agencies on establishing whistleblower policies and procedures and protecting whistleblowers according to the Liberian legislation and the international best practices. Also, the consultant will advise several agencies on the development of the internal policies and procedures related to whistleblower protection.
The consultant will be supported by LPAC technical staff with expertise in investigation, prosecution and legal drafting. This assignment is scheduled for early 2020.
Responsibilities:
- Review the draft whistleblower protection bill and other relevant Liberian laws and policies, conduct consultations with stakeholders, provide expert opinion and recommendations taking into account Liberian context, applicable international experience, and best practices, and discuss it at the roundtable.
- Conduct 3-day training for representatives of the law enforcement and regulatory agencies on establishing whistleblower policies and procedures and protecting whistleblowers according to the Liberian legislation and the international best practices.
- Advice agencies on the development of the internal policies for receiving and processing disclosures and protecting whistleblowers.
Required Qualifications:
- Masters degree in law, public management or administration, criminal justice, or other relevant field.
- At least 10 years of experience of working with, developing and or applying whistleblower laws, practice and policies in a government environment, ideally in or with law enforcement and regulatory agencies.
- At least 5 years of experience in training government officers.
- Proven knowledge of relevant international experience in whistleblower legislation, institutional framework, and implementation of the legislation.
- Experience working with USAID or another donor program is preferred.
- Experience working in Liberia or similar countries is preferred.
- Fluent English language is required with strong oral and written communication skills.
