  1. Background

    The International Labour Organization (ILO), with financial support from the United Kingdom’s Foreign Commonwealth and Development Office, is implementing the “Better Regional Migration Management” (BRMM) programme across seven countries in the East and Horn of Africa. This programme aims to strengthen the capacity of these countries to manage labour migration through evidence-based policies, improved qualifications and skills for migrant workers, and active engagement with social partners to enhance development outcomes.

    As part of the BRMM Project, the ILO supported the Government of Somalia in developing a regulatory guideline and legislative proposal for private employment agencies (PrEAs) inclusive of an implementation plan. This work is undertaken in close collaboration with the Ministry of Labour and Social Affairs (MoLSA) and various relevant state and non-state actors including social partners and PrEAs; with the aim of promoting fair recruitment and regulating the operation of PrEAs based on Convention No. 181, Recommendation No. 188 and the General Principles and Operational Guidelines for Fair Recruitment and Definition of Recruitment Fees and Related Costs (GPOG and Definition).

    Following the process of the regulation’s development, the final PrEAs regulation and its implementation plan has been developed and validated in English during the validation workshop in October 2024 in Mogadishu. However, to ensure accessibility and usability within Somalia’s governmental processes, MoLSA has requested a Somali-language translation of the regulation. This translation is crucial for further consultations with the Ministry of Justice, with the goal of presenting the regulation to Somalia’s government cabinet for approval and adoption.

    To facilitate this critical step, the ILO, in close collaboration with MoLSA, is seeking the services of a qualified national translator to accurately translate the proposed PrEAs regulations from English into Somali.

  2. Objective and scope of the assignment.

The objective of this assignment is to translate the recently proposed PrEAs regulation from English into Somlai language. The two document are as followings:

  1. Key activities

Under the overall guidance of the Chief Technical Advisor and National Project Officer of the ILO BRMM, as well as the Office of the General Director and the Legal and Labour Department at MoLSA, the consultant will be responsible for translating from English to Somali the Regulatory Guidelines and Legislative Proposal (Regulation) for Private Employment Agencies, along with the Procedure and General Services of the Regulatory Guidelines and Legislative Proposal (Regulation) for Private Employment Agencies for the Federal Republic of Somalia. Specifically, the consultant’s duties include:

  • Producing an accurate translation of the Legislative Proposal (Regulation) for Private Employment Agencies and Procedure and General Services of the Regulatory Guidelines from English to Somali.
  • Ensuring content accuracy through conducting a detailed comparison, checking legal terminology, and verifying that no content is omitted.
  • Performing terminology research and cross-checking with relevant national legislation, including the revised Somali National Labour Code and the National Overseas Act, to ensure translation accuracy and appropriateness.
  • Collaborate closely with MoLSA officials and regulatory experts within the ministry.
  • Liaise with the Office of the Minister and Directors General to provide progress updates as needed.
  • Proofreading the Somali document to ensure correct vocabulary, expression, grammar, and terminology.
  • Delivering a high-quality translation that accurately reflects the meaning of the source document.
  • Ensuring the final text is free from typographical errors.
  1. Expected Outputs

The expected output from this consultancy will be that the ‘Regulatory Guidelines and Legislative Proposal (Regulation) and the Procedure and General Services of the Regulatory Guidelines and Legislative Proposal (Regulation) for Private Employment Agencies for the Federal Republic of Somalia’ is translated into the Somalia language and arranged in the same format as the original document.

  1. REQUIRED SKILLS AND EXPERIENCE

The assignment shall be contracted to a national individual consultant (who is available immediately given the priority of the work) with demonstrated skill and expertise in translation works of technical and legal documents (from English to Somali language).

The successful Consultant shall have the following qualifications and competencies:

  • Advanced proficiency in English and Somali, with strong oral and written communication skills.
  • University degree in law or a related field.
  • Minimum of 5 years of relevant experience in translating technical and legal documents (from English to Somali), including regulatory frameworks and/or documents related to labour migration, public employment, or similar areas.
  • Experience working with MoLSA and other government agencies (e.g., Labour Code, Overseas Act, rules, regulations) is preferred.
  • Experience translating documents for ILO and other UN agencies from English to Somali.
  • Demonstrated expertise in translating professional legal and technical documents for public sector entities, ideally including the Ministry of Labour and Social Affairs, Ministry of Justice, private employment agencies, and multilateral organizations (samples of previous work may be requested).
  • Technical competence in relevant terminology, with a solid understanding of labour migration, private employment agencies, fair employment practices, decent work, and national and international labour standards, regulations, and laws.
  • Proven ability to meet tight deadlines and deliver high-quality translations on schedule.
  1. Time frame

The work will be carried out between 01 January to 28 February 2025.

The initial translation should be completed and submitted no later than 27 January 2025.

  1. Fees for the service:

The fees for the service shall be per words basis.

The payment shall be made in two instalments as following:

  • 50% of the total amount upon satisfactory submission of the final translation of the proposed PrEAs regulations and General procedures document to the satisfaction of the ILO and MoLSA.
  • 50% upon the satisfactory submission of the final translation of the proposed PrEAs regulations and General procedures document to the satisfaction of the ILO and subject to approval by MoLSA.
