The USAID-funded Transform WASH project in Mozambique, implemented by Tetra Tech International Development (International Development Jobs – Tetra Tech), is currently accepting expressions of interest for a Legal Advisor Specialist for a short-term technical assignment (STTA). This position will be located in one of the project office locations in Maputo or Nampula or can be done remotely if the recipient has very good knowledge of Mozambique context. The LOE for this assignment is 25 days between 15 April 2024 to 30 September 2024.

Position Description/Summary: The main objective of the assignment is to conduct a detailed review of the potential bottlenecks of the current Mozambique PPP law for private investment in water supply and sanitation projects, prepare the regulation which enables private sector participation in water sector projects, and in parallel, provide legal advisory services to AIAS on an ongoing basis and develop potential new PPP provisions for piped water supply systems investments, as required. The Legal Advisor is expected to work in close collaboration with the Transactional Advisor to deliver the assignment.

Responsibilities:

* Review the current Mozambique PPP law to identify potential bottlenecks for private sector investment in the sector.

* Develop a proposal of specific provisions to be considered for the water sector, aimed at making private investment viable in the sector.

* Develop a proposal to align the implementation of PPP projects in the water sector with the public contracting procurement procedures.

* Prepare the regulation which provides the enabling environment for private sector investment in PPP water projects.

* Recommend alternative approaches for approval of the proposed improvements to the law, considering regulation of the water supply and sanitation law or as specific regulation of the PPP law applicable to the water sector.

* Provide strategic legal advisory services and support as requested by AIAS, and approved by Tetra Tech, to ensure legal protection of the interests of AIAS and the GRM, as they advance towards the implementation of the concession contract with Operation Water for eight piped water systems, signed in 2021.

* Provide legal support as requested by AIAS and approved by Tetra Tech, to ensure legal protection of the interests of AIAS and the GRM as they advance with discussions with new prospective investors for investment in piped water systems, including through concession or through improved lease contracts.

* Provide legal services related to the development and implementation of improved performance of its selected private partners incentivized within the contractual structure to provide the required services by AIAS.

Minimum Qualification Requirements:

* Master’s degree and 7 years of experience OR bachelor’s degree with 10 years of experience in the relevant field.

* Masters or Law Degree or other related legal degree. Specialization in contract law or contract-related courses are advantages.

* At least 7 years of practical experience in legal advisory services related to PPP investments legislations development or implementation.

* At least 3 concession contracts supported.

* Experience in supporting similar legal initiatives such as donors’ mobilization, financial resources mobilization and/or related experience.

* Ability to listen, capture contributions, and identify key consensual aspects and issues to be worked between different stakeholders with potential competitive and sometimes conflicting interests.

* Proficiency in Microsoft software (Word, Excel, and PowerPoint).

* Fluency in English and Portuguese (written and spoken at a professional level).

Tetra Tech is helping to improve the capacity of non-governmental organizations (NGOs) and civil society organizations (CSOs) to increase the practical knowledge of vulnerable Iraqis of their rights, responsibilities, and remedies under the law. The program aims to increase the competence and availability of legal professionals assisting vulnerable populations, and to improve government processes to facilitate access to government services and legal remedies. The program has a particular emphasis on improving access to justice for women and youth.

We are managing an $8.25 million grants program that provides funds to Iraqi NGOs, law schools, and bar associations operating in 13 of the 18 Iraqi provinces. The program has disseminated more than 60,000 public awareness materials, supported 4,842 legal cases on behalf of vulnerable Iraqis, established 30 grassroots legal clinics, and provided more than 32,000 person-days of education to vulnerable Iraqis on their legal rights; more than 75 percent of participants have been women.

In addition, five universities have launched legal clinic practicum courses and have established law school legal clinics providing legal services to vulnerable Iraqis.
