TERMS OF REFERENCE FOR A LOCAL CONSULTANT TO TRAIN AND SUPPORT MEDIATION COMMITTEES IN TEREGO DISTRICT

1.About ZOA

ZOA is an International Non-Governmental Organisation working in Uganda since 1998. Its mission is to assist in rebuilding the livelihoods of people who are affected by human conflict or natural disasters. ZOA operates in 16 countries in Africa, Asia and the Middle East. Its community-based programme in Uganda concentrates on Food Security, Livelihoods/Economic Development, Skills development, Education and Peace Building and is implemented in close cooperation with local organizations and local governments.

ZOA West Nile is implementing the Landrights project in Uriama subcounty in Terego District in the parishes of Otumbari, Ejoni, Akinio and Maraju. One of the outputs of the project focuses on land conflict prevention and resolution processes. For long-term impact, land rights work needs to address unequal land access, land related grievances and improve land tenure security. To ensure a conflict sensitive way of working, the project focuses on capacity building for various structures, including the land mapping and mediation teams at parish level, so that these committees can address land conflicts effectively and adequately.

Objective of the assignment: The overall objective of the assignment is to train selected community members about alternative dispute resolution (ADR) for land-related conflicts, and to build strong community structures (mediation committees) to participate in the landrights project activities.

2. The specific objectives:

  • To develop a training program for mediation in land-related conflicts for mediation committees
  • To develop training material that connects the content and the learners’ needs
  • To develop a training methodology that focuses on Alternative Dispute Resolution (ADR)
  • To train mediation committees of around 28 participants in 4 selected parishes of Uriama
  • To coach the mediation committees so that they are competent to carry out mediation activities when land-related conflicts occur
  • To monitor and analyse nonverbal communication of learners and adapt accordingly
  • Support mediation committees to contextualize and develop simple tools to conduct assessments about land-related conflicts and to understand formal case referral pathways in Uganda.

3. Methodology:

The consultant should use interactive adult learning methodologies with relevant examples to the West Nile operating context. The training should include group exercises, use of pictorials, experience sharing and participatory learning. The consultant should plan for refresher trainings based on the needs identified in the inception meeting, and plan for continuous coaching and mentorship during a period of 6 months.

4. Key deliverables

  • Inception report with an outlined planning, methodology and proposed timeline and proposed budget 1 week after signing the contract
  • Conduct training of mediation teams in 4 parishes within a period of 4 weeks
  • Submit a training report within a week after the trainings that includes recommendations for the period when mediation committees start to do their mediation in parishes and villages
  • Conduct supervision and coaching of the mediation teams during their work in the field

5. Roles and responsibilities of ZOA and the Consultant

ZOA’s role and responsibilities

  • Provide details on the planned project activities for land-conflict mediation
  • Discuss selection of participants in collaboration with the subcounty
  • Organize the venue for the training and transport costs for the training participants

  • Develop training plan with methodology and training module
  • Develop detailed work plan

6). Budget and Payment

The consultant should provide a detailed budget that includes all the costs related to the training of the participants, own transport needs and coaching of mediation committees. Training plans should take into account the SOPs for COVID-19.

7). Duration of Assignment

It is proposed that the assignment will take a total period of 6 months, of which 4 weeks of training at the start and 12 days of follow-up visits in the following 5 months for supervision and coaching of the mediation teams.

8. Target audience:

Mediation committees across the parishes of Akinio , Otumbari , Ejoni and Maraju in Uriama Subcounty.

9). Expected Profile of Trainer

ZOA Uganda, West Nile Programme calls for expression of interest from consultants with the following qualifications to undertake the above-mentioned assignment.

  • A solid track record in a similar assignment.
  • Evidence of conducting similar assignments will be preferred.
  • An individual with skills, knowledge and experience in mediation.
  • Ability to understand and speak fluent Lugbara and capacity to use local language with local examples, among others considering the category of people we are going to train.

10). Terms & Conditions

  • The consultant is expected to adhere to the ZOA local security guidelines and ZOA’s Code of Conduct;
  • The consultant shall be able to demonstrate a high level of professionalism in the assigned tasks
  • The consultant shall not assign or transfer any of the expected deliverables to 3rd parties.
  • The consultant should have the required qualifications and proven experience in land conflict mediation for the execution of the tasks assigned, preferably a certified mediator on land matters.

11). Insurance and Liabilities:

  • The consultant is expected to organize his own insurance for the period of this consultancy.
  • ZOA will not be liable for costs related to accidents, physical harm, kidnappings, medical evacuation or professional negligence, third party lawsuits or other liabilities from entering contract with the consultant.
  • The consultant shall be held liable for any damage, loss due to his/her property.
